A settlement has been reached in a class action alleging that FleetOne, LLC violated the Telephone Consumer Protection Act (TCPA) by sending fax advertisements to consumers without permission and by not including in the advertisements the opt-out notice required by the TCPA.

Junk Faxes Out of Fax Machine

If you’re going to send junk faxes to consumers in violation of the Telephone Consumer Protection Act (TCPA), it might be wise not to send any of them to a law office. One of the provisions of the law is that any advertising faxes sent contain an opt-out notice that meets specific requirements, so that consumer can easily opt-out of receiving any future faxes. According to the complaint, the fax sent to the plaintiff in this action was unsolicited and did not contain the required opt-out notice.

The complaint for this class action alleges that Dental Resource Systems, also known as Trudenta, violated the Telephone Consumer Protection Act (TCPA) when it sent consumers junk faxes without their consent, and without a proper opt-out notice. The TCPA was passed because advances in technology permitted companies to contact thousands of consumers with very little effort. In particular, advertising via junk faxes was of concern because they used paper, ink, and other resources, they tied up fax machines and prevented access for more important uses, they cost people time in dealing with them, and at times they come in on lines that charge consumers for incoming calls.

This settles a class action alleging that RehabCare Group, Inc. and Cannon & Associates, doing business as Polaris Group, violated the Telephone Consumer Protection Act (TCPA). The complaint claims that the company or companies sent unsolicited telemarketing faxes that did providing the TCPA-required opt-out notice.

Komet USA has agreed to settle a class action alleging that the company violated the Telephone Consumer Protection Act (TCPA) by sending junk fax advertisements without the consent of the recipients; the class action also alleges that Komet did not include the opt-out notice required by the TCPA.

The Toner Doctor

This class action alleges that junk faxes, sent by The Toner Doctor, violate provisions of the Telephone Consumer Protection Act (TCPA) because they don’t contain the complete opt-out notices it requires.
