Unsolicited Faxes

“The TCPA expressly prohibits unsolicited fax advertising.” So begins the second paragraph of a complaint alleging that Atlas Construction Company violated the Telephone Consumer Protection Act as well as the Illinois Consumer Fraud Act (ICFA), in sending consumers unwanted advertising faxes without their consent.

The complaint for this class action alleges that Smith Medical Partners, LLC and HD Smith, LLC violated the Telephone Consumer Protection Act (TCPA) in faxing around advertisements for its products.
