Trott Law is putting up $7.5 million to settle a class action alleging that it violated the Fair Debt Collection Practices Act (FDCPA) and the Michigan Regulation of Collection Practices (RCPA) in its letters sent in connection with non-judicial foreclosures in Michigan. The complaint claimed that Trott did three improper things: (a) misleadingly suggesting they were from an attorney even though no attorney had meaningfully reviewed the accounts, (b) overshadowing the federal validation rights of the homeowners in some of letters by mentioning the possible reinstatement of the mortgage, and (c) using the undefined phrase “Corporate Advances” in some of the letters.
