A Variety of Capacitors

A large antitrust case against makers of capacitors has so far resulted in settlements totaling $80.5 million. The complaint alleged that makers conspired to raise and fix the prices of capacitors over a period of more than ten years, thus violating antitrust laws and making customers pay more for capacitors than they should have.

Three of the defendants have put up a total of more than $5 million to settle an antitrust class action on behalf of direct purchasers of alum. Alum is used to treat drinking water, control algae in lakes and ponds, treat wastewater, and for certain manufacturing purposes.

Premera Blue Cross is settling a class action with a payment of $32 million for class member benefits and $42 million for improvement of its systems. The complaint alleged that Premera did not properly safeguard customer information. Premera announced the security breach of its systems in March 2014, but the cyberattack purportedly began in May 2014.

Nature’s Way Products, LLC and Schwabe North America, Inc. are paying $1.85 million to settle a class action alleging that it advertised its Extra Virgin Coconut Oil and Liquid Coconut Oil in ways that are deceptive.

Plantronics, Inc. is settling a class action about its BackBear FIT wireless sport headphones, which it has advertised as being sweatproof, waterproof, and able to provide as many as eight hours of listening time on a charge. The complaint alleged that these claims are not true and that the headphones are therefore not worth what customers paid for them.

Tractor Supply Company and Smitty’s Supply, Inc. are settling a Missouri class action based on their sales of S SuperTrac 303 Tractor Hydraulic Fluid (THF). The complaint alleged that no real 303-type THF exists at this time and that what was sold as 303 was an inferior product that could damage equipment.

Celgene Corporation is paying $55 million to settle antitrust class actions about its drugs Thalomid and Revlimid. The complaints alleged that the company acted to keep generics of the drugs off the market for a time, forcing consumers to pay more for the drugs than they would have with open market competition.

Whirlpool Refrigerator with Bottom Freezer

Whirlpool Corporation has elected to settle a class action alleging that certain models of its refrigerators with bottom freezers may suffer the blockage of their drainage tubes. This can lead to ice build-up on the floor of the freezer or sometimes leakage.

A number of organizations holding medical records are choosing to settle a class action about fees for medical records. They include Ciox Health, LLC, HealthPort Technologies, LLC (now part of Ciox), IOD Incorporated (now part of Ciox), and Aurora Healthcare, Inc.

This settlement resolves a class action against Iowa’s Multi-State Lottery Association (MUSL). The complaint claimed that MUSL violated state laws in connection with the use of certain random number generating technology when it conducted drawings for intra- and interstate lotteries.
