Wind Farm

Plaintiff Kevin Kohmetscher grew up on an eleven-acre piece of land in Nebraska that has been owned by his family for decades. In November 2017, the Cottonwood Wind Farm went into operation on an adjacent piece of land. The complaint for this class action says that the wind farm is causing health and other problems for the people who live near it. The complaint claims private nuisance and negligence.

Big Ox Energy Facility in South Sioux City

It’s possible to make energy out of waste materials. Big Ox Energy, LLC has a facility for doing just that in South Sioux City, Nebraska. However, the complaint for this class action claims that Big Ox’s facility is not properly maintained and operated, causing noxious odors to escape into the surrounding community. 

Grain Processing Corporation Plant in Muscatine, Iowa

A Muscatine, Iowa company is settling a class action, with both payouts and promises to install better pollution control equipment. The complaint alleged that smoke, odor, and haze from the Grain Processing Corporation’s plant caused a nuisance to area residents. 

Amtrak Train

Amtrak had RWC, Inc. spray herbicide along Amtrak rail lines in Philadelphia to keep down the vegetation, the complaint for this class action says, but they also managed to kill gardens and other vegetation belonging to people who live along the tracks.

Husky Superior Refinery Fire

When the Husky Superior Refinery exploded, on April 26, 2018, Plaintiffs Jasen Bruzek, Hope Koplin, and Neil Miller, were forced to evacuate their homes, along with other residents of Superior, Wisconsin. The complaint for this class action alleges that Husky Energy, Inc. and Superior Refining Company, LLC are responsible for the explosion and the losses that evacuees suffered.

Stony Hollow Landfill, Inc. is settling a class action alleging that it is responsible for at least some of the pollutants, air contaminants, and bad odors coming from the landfill. 

IESI PA Bethlehem Landfill

The address is Applebutter Road, but the business located there in this Pennsylvania community doesn’t smell like grandma’s kitchen. The complaint for this class action says that the waste and disposal facility operated by Bethlehem Landfill Company generates noxious odors that are a nuisance to the surrounding community and fails to take legally-required steps to monitor and manage them.

CSX Train

On August 2, 2017, just before five in the morning, a freight train derailed near Hyndman, Pennsylvania. Minutes later, Plaintiff Denora Diehl and about a thousand other people in the area were evacuated. Diehl was not permitted to return home until August 20. The complaint alleges an astonishing level of negligence on the part of the train’s operator, CSX Transportation, leading up to the accident, and nuisance for area residents.

Police Direct Traffic as Marathon Fire Burns

Marathon Petroleum Corporation has agreed to settle a class action alleging that the company was negligent in not properly monitoring or maintaining the aboveground storage tank resulting in an explosion and fire on April 27, 2013, causing an alleged nuisance to people in neighboring areas.

April 3, 2015 Fire at GE's Appliance Park

A $1.2 million settlement fund has been set up to settle claims stemming from the alleged property damage, inconvenience, and nuisance caused by a fire on April 3, 2015 in Building 6 at GE’s Appliance Park in Louisville, Kentucky. Residents in the area were told to shelter in place from April 3-5, 2015, with doors and windows closed and air conditioners off.
