Failure to Pay Reporting Time Pay

The plaintiffs in this lawsuit allege that AAFES failed to pay employees differential pay.  Differential pay is the premium pay that employees working the second shift (3:00 PM - midnight) and the third shift (11:00 PM - 8:00 AM) are entitled to receive.  The second shift is entitled to 7.5% additional pay and the third shift is entitled to 10% additional pay.

            This class action lawsuit claims that Petco stores in Massachusetts failed to pay Assistant Store Managers (ASMs) for all hours worked, failed to pay ASMs overtime on a timely basis, and failed to pay ASMs the legally required amount of overtime compensation required by law for all hours worked over 40 in a workweek.
