Collusion & Price Fixing

ANA Plane Painted with Pikachu Motif

All Nippon Airways Company, Limited (ANA) was the last holdout in a class action against thirteen airlines for conspiring to fix prices on transpacific travel and on fuel surcharges for such travel. It has now agreed to pay $58 million to settle its portion of this case.

Linear Resistor

A number of makers of electronic components have agreed to settle an antitrust case against them for more than $50 million. The complaint alleged that the companies colluded to raise, fix, maintain, or stabilize the price of linear resistors, which is forbidden by the Sherman Act.

Beef Cattle in Field

This antitrust class action brings suit against a number of beef packers for colluding to depress the prices of fed cattle. Because the packers earn their money from the “meat margin”—the spread between the price of fed cattle and the price at which the meat is sold—the companies allegedly decided to earn more by depressing the price of the cattle. The defendants in this case include Tyson, JBS, Swift, Cargill, Marfrig, and National.

Viega Copper Press Fittings

Viega, LLC makes fittings. The complaint for this class action brings suit against it under federal and state antitrust laws, alleging that the company has engaged in anticompetitive behavior in the market for copper press fittings and carbon steel press fittings.

Farmed Atlantic Salmon Steak on Ice

Early on, the complaint for this class action says, “In February 2019, the European Commission announced that its antitrust enforcement agents had executed dawn raids on corporate offices and facilities” of companies that produce farmed Atlantic salmon, out of suspicions they may have violated antitrust laws. This class action seems to have grown out of that European action, bringing suit on behalf of American parties who were injured by the anticompetitive behavior.

Building with Bayer Sign on Side

The complaint for this class action is almost word-for-word identical to one filed at the end of June, from a different plaintiff, alleging that an anticompetitive conspiracy has existed in the US since at least January 1, 2016 to raise the price of MDIs and TDIs, which are precursor ingredients for foam and related products.

Eversource Energy Logo

Eversource Energy and Avangrid, Inc. are energy suppliers in New England. The complaint for this class action alleges that the two companies engaged in a conspiracy to raise the price of electricity for wholesale buyers—interestingly, by manipulating the price of natural gas.

Covestro Plant

The complaint for this class action alleges that an anticompetitive conspiracy has existed in the US to raise the price of MDIs and TDIs, which are precursor ingredients for foam and related products, since at least January 1, 2016.

Panasonic Inductor

The US Department of Justice obtained guilty pleas in a recent antitrust case relating to makers of capacitors. Now comes a similar price-fixing case relating to makers of inductors, another type of electronic component, alleging violations of the Sherman Act. The complaint alleges that the defendants, who control 75% of the global market, colluded to raise inductor prices and keep them high.

Davis Vision

This antitrust class action has been brought against Davis Vision and related parties, alleging that the company has used its market dominance as a provider of vision insurance benefits to enforce anticompetitive and other unlawful practices in the Pennsylvania eye care market.
