Breach of warranty

2019 Ford F-150 Truck

The complaint for this class action is one of several filed recently that accuses the Ford Motor Company of fudging the figures it used in its fuel efficiency testing. The purpose, the complaint says, was to make it look as if Ford vehicles, including the Ranger and F-150, had greater fuel efficiency than they do.

Ford 2017 F-350 Truck

The complaint for this class action is a massive document of over 860 pages. It alleges that Ford knew it should not use Bosch’s CP4 fuel pump in its diesel vehicles, but did so anyway. What was wrong with the CP4? Because US diesel fuel differs from European, the fuel pump does not work as it’s intended and eventually causes engine damage.

Blendtec Designer 650 Blender

How strong are the motors of blenders? The complaint for this class action alleges that Blendtec, Inc. and its parent company, K-Tech Holdings, Ltd., advertise higher power for their blenders than they are able to achieve, specifically 3.0 and 3.8 peak horsepower (HP).

2017 Tesla Model S 60

Are Teslas cutting-edge vehicles? What would a used Tesla be like? Tesla touts its “best warranty and service program in the world,” but the complaint for this class action alleges that some buyers of pre-owned Teslas can’t get warranty coverage for needed battery repairs or replacement.

Five-Gallon Container of O'Reilly Automotive 303 Tractor Hydraulic Fluid

Why are companies still selling what purports to be 303 tractor hydraulic fluid when it’s obsolete? And how is it possible for a tractor hydraulic fluid to even be obsolete? That’s what the complaint takes up in this Missouri class action against O’Reilly Automotive, Inc., Ozark Automotive Distributors, Inc., O’Reilly Automotive Stores, Inc. (doing business as O’Reilly Auto Parts), and Omni Specialty Packaging, LLC.

Bottle of Borage Therapy Children's Lotion

Consumers these days want products with natural ingredients, and they are willing to pay more for them. This has led some companies to make “natural” or “all natural” claims for products that aren’t really true. The complaint for this class action alleges that Trans-India Products Inc., which does business as Shikai Products, represents that its shampoos, lotions, and other products are “natural” when they actually contain synthetic ingredients.

Male Hand Holding Container of Sperm

What should a sperm bank know about the product it sells? The complaint for this class action alleges that Manhattan Cryobank, Inc. (MCB) sold semen to customers that had not been adequately screened for genetically-based diseases.

GM 2016 Silverado Truck

This is one of several recent class actions brought against General Motors for the use of Bosch’s CP4 fuel pumps in diesel vehicles. The complaint alleges that the CP4 cannot work properly with American diesel fuel, which does not provide enough lubrication. The result is eventual failures requiring the replacement of the fuel system.

Package of Pepperidge Farm Texas Toast

The package for Pepperidge Farm’s Texas Toast shows two thick slices of toasted bread with a yellow spread and parsley flakes, a fresh garlic clove and parsley leaf, pats of butter, and the words, “Made with real Garlic[,] Butter & Parsley.” It looks mouth-wateringly delicious—assuming, of course, that the yellow spread is butter. Unfortunately, the complaint for this class action alleges that most of it is palm and soybean oils, with added coloring, while butter makes up less than two percent of the product.

Tootsie Rolls, Wrapped and Unwrapped

Were Tootsie Rolls and Tootsie Pops made until recently with an unhealthy substance, that is, partially hydrogenated oil (PHO)? The complaint for this class action says they were, despite a declaratory order from the Food and Drug Administration (FDA).
